Any purchase of goods from the site www.berkshirejagcomponents.com requires the customer to consult and accept these terms and conditions.
The click validating the order implies full acceptance of these terms and represents the customer's "digital signature".
These terms and conditions are intended to define the rights and obligations of the parties in the sale of goods proposed online by Berkshire Jag Components for the customer.
All contractual information will be confirmed by email to the address specified by the customer during the purchasing act.
Proof of Transaction
The records stored in Berkshire Jag Components computer systems under reasonable safety conditions are considered proof of communications, orders and payments made between the parties.
Purchase orders and invoices are stored on a reliable and durable system and can be produced as evidence.
Every effort has been made to ensure the accuracy of the information presented on berkshirejagcomponents.com. Berkshire Jag Components or its suppliers shall not be held liable for the consequences, accidents, or special damages arising from electronic transmissions or the accuracy of transmitted information, even in cases where Berkshire Jag Components was aware of the possibility of such damages. Manufacturer and brand names are only used for identification purposes. Product photos, descriptions and prices are non-contractual and may vary.
Validity Period of Offer and Prices
Our offers and prices are valid for the day the site is consulted and are subject to change without notice.
Dispatch Time 1-2 Working Days
Orders would normally be dispatched the same day of purchase but due to the order volumes this has changed to a 1-2 Working days.
Once the order has been dispatched DPD aim to deliver the Next Working Day. Please note that all delivery times are estimates not guarenteed due to restrictions .

**There are countries where non-essential shops and businesses are closed therefore, we advise you check before ordering that your address is able to receive parcels, to avoid unnecessary costs.
DPD will attempt delivery where possible, if there is restriction then the parcel will be returned to us.
Unfortunately, if this is the case then we will not be held liable for the refund of your delivery charge. If the item needs to be sent again this will be done but an additional delivery charge will be applied.

Orders placed between 14:00 Friday 22nd December to Monday 1st January will not be dispatched until we return on Tuesday 2nd January.
Due to high volumes Processing times may take 1-2 working day before dispatched.
Please note during our Holiday Break we will be unable to answer any emails or questions regarding products, orders or refund until we return on Tuesday 2nd January 2024.
Products are delivered to the address specified by the customer on the purchase order and only to geographic zones that we service.
All products leave our premises in perfect condition. The customer must notify the carrier (or postman) of even the slightest trace of damage (holes, signs of crushing, etc.) to the parcel.
No exchanges can be made at a later time for goods claiming to be damaged during carriage without notification at the time of reception.
As with any shipment, a delay or loss of goods is possible. In such a case, the carrier shall start an investigation. Every effort is made, for as long as necessary, to find the package. If the package is not found, the carrier will reimburse Berkshire Jag Components, who will deliver a new, identical package to the customer free of charge.
We shall not be held responsible for delayed delivery times due to the carrier, including for the loss of goods, bad weather or strikes.
If for any reason you do not wish for your parcel to be left with a neighbour or you would like you parcel to be left in a safe location, please leave a delivery note on your order with more details

When placing an order, you will need to pay Custom Fees when the parcel arrives in your country. This is something out of our control and we have nothing to do with what is charged by Customs. Customs will contact you Via Email or Telephone. They will require a payment for the parcel to be released for delivery. Please make sure you check your Email and your Junk Mail for this information.
Failing to pay Custom Charges or Refusing the Parcel can resort in the parcel being rejected and returned to us. If this happens, we get charged a custom fee for the parcel to be returned to us.
As this fee is no fault of Berkshire Jags, we will be unable to credit your account with the full refund. Your goods payment will be refund minus the charge of Shipping and the Return Fee.
If there are any problems, you must let us know as soon as possible. If the parcel has already left the UK, we are unable to make any changes to solve this issue.
Products must be returned undamaged in their original packaging and be deemed fit to be resold as new.
If the original packaging surrounding the product has been damaged or destroyed we will only issue a refund if the product is being returned due to a defect.
If the original packaging of a defective product has been damaged or destroyed you should ensure that the returned product is adequately packed for shipment back to us.
You are responsible for paying any postage or shipping costs incurred when returning the product and its safe arrival at our works.
We recommend that all returns be sent by registered post, so that a record of the return is available for you. We will not issue refunds for any items damaged, lost or stolen in transit to us. Where a return is damaged, lost or stolen in transit to us, you should claim compensation from the company that shipped the return. If you fail to return a product to us, we may make arrangements to have the product collected from you.
The cost of this collection will be charged to you.
Unused products may be returned promptly by customers within 14 days of receipt to our address listed in the contact details of our website, We accept no returns after 14 days of receipt of goods Subject to the above.
We will refund the purchase price of a returned product within 5 days of recieving the goods back. If the item as unwanted or failure to deliver we can only refund the price of the product returned Postage will not be included in the refund.
Returns will be processed for a refunded once the item has been received. Your refund will be issued within 5 Working days. Please note if your original purchase was made by Card payment there is a additional 3-5 Working days for your Card Processor to complete the refund to show in your account. Please note Different Card Processors do have different refund time scales for this to show in your account. This is something out of our control. Please leave 10 Working Days before seeking more information.
If an item is Faulty, we ask that you contact us first by email email@example.com or phone 01189 787896.
We will ask you a few questions about the fault of the item to see if the issue is with the Part purchased. You will be required to fill in a Returns form and return this to us.
Once the part has been received, we will check the part first, if the part has a visual fault another one will be sent, or a Parts refund will be issued.
If the Fault needs further investigations, we will send this off to the manufacturers for test. If additional Information is needed, we will contact you Via Email. Once the Fault has been confirmed following investigation a refund will be issued. If the fault is not due to manufacturing issues then the claim will be unsuccessful and we will be unable to refund the part.
If a replacement part is urgent, this will have to be purchased again. Once the item has been received back and the faulty is confirmed a refund of the replacement part will be issued.
No replacement parts or refunds will be issued until the part is returned to us and the fault is confirmed.
Any Items purchased as a reconditioned part which requires your old unit to be returned to us will have the surcharge included in the price of the product. The Amount that will be refunded will show in the Product Description.
Once your old part has been returned to us, we will check the item to make sure that the item is fit for reconditioning. If the item is good, then a surcharge refund will be refunded Via the originalpayment method.
If we receive the product back and the old part is broken, damaged beyond repair or has been heated to remove parts then this will make the item invalid and the surcharge will NOT be refunded.
We advise leaving bushes and ball joints etc in-place as we have the machines to remove them correctly and by doing this will not affect your old part surcharge refund. We cannot be held responsible for your mechanics removal. If they damage the part while its being removed this will have to be discussed with them.
Reconditioned Exchange Parts International Orders
If you are sending a Reconditioned part to us for repair, you will have to pay Customs Fees for us to receive the goods plus there will also be Customs Fee on the part going back into your Country.
Unfortunately, this is something out of our control and there is no way of us bypassing these, Fees.
When sending your parcel with your courier, there should be an option to select who pays the Import Fee.
To make this easier please select 'The Sender'. By doing this the Courier will contact you when the parcel is in the UK ready for delivery.
The Courier will give you instructions, so you know how to make the payment.
If the parcel is sent, and this isn’t adjusted on the Consignment an Invoice will be forwarded on to you.
Berkshire Jags will not be responsible for the payment.
If the payment is not made this can cause the parcel to be rejected and returned to the sender.
We ask that anyone sending their goods please also email us on firstname.lastname@example.org with their Tracking Number and Order Number.
Please remember, when sending your goods to make sure that you have also included your Name and Order Number inside this so we know who's part belongs to who. (Your Order Number will be emailed to you when the order is placed)
Reconditioned Exchange Parts Returns (UK ONLY)
**Free UK Returns is Currently Unavailable**
Any parts purchased with a 'Free Returns' Service will be provided with a Dpd Returns Form. This form will be enclosed with you part.
Please follow the instructions on the form. We also advise that the part be packed securly to prevent damage.
Dpd Return parcel will need to be dropped off at a Dpd Pickup Shop. A list will be provided with your form, alternativly you can check on www.dpd.co.uk/pickuplocator
Free Returns service is only avaliable through Dpd Pickup, if another delivery service is used we will not be responsible for the charges against the parcel to return to us.
There are 3 Simple steps to ensure your parcel is returned safely.
1. Make sure all old labels are removed from your box/packaging.
2. Securely attach the label to your parcel.
3. Choose from the most convenient DPD Pickup Shop from the list provided on your returns label to return your parcel to.

Loss or Damage in Transit
Berkshire Jag Components will not be responsible for damage or loss of goods or part thereof in transit or for any discrepancy between the goods delivered and the goods ordered unless the customer gives written or email notice of a claim to Berkshire Jag Components and the carrier within three (3) business days of delivery.
In the event of damage of goods or part thereof in transit or for any discrepancy between the goods delivered and the goods ordered, the customer must hold the goods and make them available for inspection or collection by Berkshire Jag Components or its representatives on request.
The customer must inform Berkshire Jag Components immediately (the same day or, at the latest, the first business day following delivery) concerning any claim of delivery error or non-conformity of goods, in kind or in quality, compared with the information on the purchase order.
Any claim made after this time period will be rejected.
Any claim that does not respect the rules defined above cannot be taken into account and releases Berkshire Jag Components of any responsibility to the customer.
In the case of delivery error or exchange, all goods to be exchanged or refunded must be returned to Berkshire Jag Components in whole, in its original packaging and in perfect condition to

For claims to be accepted, the customer must first make a declaration to Berkshire Jag Components concerning any returns and receive and Berkshire Jag Components consent. If accepted, the customer will ship the package to Berkshire Jag Components.
Shipping fees shall be at Berkshire Jag Components expense, except in the case where the goods do not correspond to the original declaration made by the customer concerning the return.
The provisions hereof cannot deprive the customer of their right to legal warranty requiring Berkshire Jag Components to protect the customer against latent defects of goods sold.
The customer is expressly informed that Berkshire Jag Components is not the manufacturer of the goods presented in berkshirejagcomponents.com and that Berkshire Jag Components shall not be held liable for defective goods.
In the case of damage to a person or property resulting from a product defect, only the product manufacturer shall be held liable and sought after by the customer, by means of the information provided on the packaging of said product.
All products sold on berkshirejagcomponents.com are under a one (1) year warranty. All products that have been modified or repaired by the customer or any other party not chosen by Berkshire Jag Components are not covered by this warranty.
The warranty can be extended according to the terms provided in store and on the website.
Right to Withdrawal
In accordance with the Distance Selling Regulations 2000, the customer has the right to a cooling off period of seven (7) business days, starting at the time goods are received, to cancel the contract and return said goods at their own expense, without having to give a reason. The cooling off period and right to cancel do not apply to contracts, orders for any goods made to your specification, sealed Electrical items, parts fitted to your car to test a problem and any downloaded goods or unsealed goods including but not limited to (DVD, CD, Tapes, Software, Video and audio).
Only complete and unused goods in perfect condition for resale will be accepted. No refunds or exchanges will be made for incomplete, damaged or unsealed goods, including damage to original packaging. The customer can exercise this right to withdrawal without penalty, excepting the return fee for the goods. If the customer exercises the right to withdrawal, they have the option of requesting a full refund or exchange of goods. If an exchange is requested, all shipping expenses shall be the responsibility of the customer.
If the right to withdrawal is exercised, Berkshire Jag Components will make every effort to refund the customer within 30 days.
Right of Use
The use of any trademarks, logos or brands present on the site is strictly forbidden. All product Photos on berkshirejagcomponents.com are property of Berkshire Jag Components, unotherised copying or use of these photo will result in legal action.
Neither party will be deemed to be in breach of any of its obligations under the agreement as a result of any delay in performing or any failure to perform any such obligations by reason of any cause or event beyond the parties' control. A force majeure event includes, but is not limited to, any unforeseeable, inevitable, or unstoppable act, event, non-happening, omission or accident beyond the control of either party, despite all reasonable efforts made to the contrary. In addition to events usually recognized by the British courts, a force majeure event includes in particular (without limitation) the following: Strike, lock-out, earthquake, fire, storm, flood, lightning, explosion, impossibility of the use of public or private telecommunications networks.
In such circumstances, the party delayed or unable to perform ("Delayed Party") shall notify the other party ("Affected Party") within ten (10) business days following the date such events become known.
Unless prevented due to force majeure, both parties will meet within three months to examine the impact of the event and agree to the conditions under which the contract shall be continued. If the force majeure lasts longer than one (1) month, this agreement may be terminated by the injured party.
These terms and conditions remain valid and in force, even if one or more clauses are invalid or declared so under any law, regulation or following the final decision of a competent court.
No failure of either party to exercise any power given to it in these terms and conditions or to insist upon strict compliance by the other party with its obligations hereunder shall constitute a waiver of either party's right to demand exact compliance with the terms hereof.
All personal data you provide us is used to process your orders. This data will be treated in accordance with the Data Protection principles outlined in the Data Protection Act 1998.
Applicable Law and Competent Jurisdiction
In form and content, these Terms and Conditions shall be governed by and construed in accordance with English law. All orders placed on berkshirejagcomponents.com strictly imply the acceptance of Berkshire Jag Components terms and conditions.
In case of dispute or claim, the customer agrees to seek an amicable solution with Berkshire Jag Components before proceeding with any legal action. In the event where such a solution cannot be found, any disputes concerning the sale (price, Terms and Conditions, products, etc.) will be subject to the exclusive jurisdiction of the English courts.
